What to do if you were arrested

• You have the right to remain silent. You can say: “I want to remain silent and I want a lawyer.”
• You have the right to a lawyer. If you can’t afford one, the court will appoint one.
• You do not have to consent to a search. Say so calmly, and don’t physically resist.

1. Don’t discuss the case with anyone, including on phone calls from jail, which are usually recorded, and on social media.
2. Keep every document: citation, bail or release paperwork, property receipt, and DMV notice.
3. Write down what happened while you remember it.
4. If it was a DUI arrest, you have 10 days to request a DMV hearing (DMV).
5. Find your court date and courthouse on your paperwork, and do not miss it.
6. Call a lawyer before your first court date.

Your first court date is usually the arraignment, where you hear the charges and enter a plea. Misdemeanors then usually go to a pretrial conference. Felonies generally have a preliminary hearing.
