The Difference Between Misdemeanors and Felonies in California

Misdemeanors vs. Felonies: Understanding the Difference

In California, criminal offenses are classified as either misdemeanors or felonies, with significant differences in penalties, procedures, and long-term consequences.

Misdemeanor Offenses:

  • Maximum jail time: Up to 1 year in county jail
  • Fines: Up to $2,500
  • Probation: Up to 3 years
  • Criminal record: Yes, but generally less severe impact than a felony
  • Examples: Petty theft, simple assault, many first-time DUI cases

Felony Offenses:

  • Maximum prison time: 16 months to life in state prison
  • Fines: Up to $10,000 or more
  • Probation: Up to 5 years
  • Criminal record: Serious, long-term consequences
  • Examples: Burglary, robbery, drug manufacturing

Why Classification Matters:

Charge classification shapes defense strategy. Reducing a felony to a misdemeanor through negotiation can dramatically change penalties and long-term consequences for employment, housing, licensing, and immigration.
