DUI Checkpoints: What to Expect and How to Protect Your Rights

Navigating California DUI Checkpoints

DUI checkpoints, also known as sobriety checkpoints, are common on California roadways. While legal, these checkpoints must follow constitutional guidelines.

What Officers Can Legally Do:

  • Stop vehicles based on objective criteria (every vehicle, every other vehicle, etc.)
  • Ask you to produce your driver's license and registration
  • Observe you for signs of intoxication
  • Request that you perform field sobriety tests
  • Administer a preliminary alcohol screening test (with your consent)

What You Should Do:

  1. Be polite and cooperative
  2. Clearly state if you wish to refuse field sobriety tests
  3. Do not consent to chemical testing without first speaking with counsel when possible
  4. Remember that refusal can result in license suspension, but may matter for your defense
