California Self-Defense Laws: Your Right to Protect Yourself

California law recognizes your right to defend yourself and others from harm, but self-defense claims must meet specific legal requirements.

Legal Requirements for Self-Defense:

  • Reasonable belief of imminent harm — You must genuinely believe you or someone else is about to be harmed
  • Reasonable force — The force used must be proportional to the threat
  • No duty to retreat — In California, you are generally not required to retreat if you are in a place you have a right to be
  • Stand Your Ground — You can use reasonable force to defend yourself without retreating

When Self-Defense May Apply:

  • Defending against assault or battery
  • Protecting others from harm
  • Defending your home (Castle Doctrine)
  • Protecting against threats of deadly force

Common Self-Defense Mistakes:

  • Using excessive force
  • Continuing to fight after the threat has ended
  • Misjudging the level of threat
  • Failing to report the incident properly
